Eugene Volokh writes about Redefining “Sexual Torture” – so here’s my 10 cents on the issue.
The way to think about this issue is to put yourself in the shoes of the prisoner. Think for a moment what a captor might do to you to insult your religion, or to embarrass you in some way – perhaps by doing something that is socially unacceptable to you.
Once you’ve thought up some things that your captor might do to you, ask yourself whether you think they violate the Geneva convention – or whether they would even qualify as “torture.”
For myself, although I can think of a lot of things that I wouldn’t like my captor to do, none of them seems unreasonable or cruel – and thus (legally speaking, anyway) perfectly OK to do.
